Action Taken at June 16, 2009 Meeting

Shall the commission:

98. Increase by $50,000 the contingency fee with Ebenal General for the 2010 Olympic Coordination Center? The federal government is leasing (see 1/6/09 meeting, vote number 14) 29,000 square feet of the International Trade Building at the Bellingham airport for two years with two one-year options. The original contract for $1,038,345 was approved at the 3/17/09 meeting, vote number 50. A contingency fee of $103,655 brought the total contract to $1,142,000. This vote will increase the contingency fee to $153,655 and will purchase additional windows, televisions, a generator and pavement repairs. The total authorized contract is $1,192,000. (New Business 1) Approved 3-0

99. Authorize the interim executive director to sign a grant extension with the state of Washington for The Waterfront District? The grant allocated $1,600,000 for site demolition and $400,0000 for planning. The grant was authorized at the 12/6/05 meeting, vote number 127. All the funds were required to be spent by 6/30/07. At the 6/5/07 meeting, vote number 75, the grant was extended through 6/30/09. To date, the port has received $1,800,000. This vote extends the contract to 6/30/11. (New Business 2) Approved 3-0

Action Taken at July 7, 2009 Meeting

Shall the commission:

100. Adopt changes to the rules, regulations and procedures for Blaine and Squalicum Harbors? Resolution 1226C, adopted at the 1/6/09 meeting, vote number 4, contained changes which were largely housekeeping. This vote addresses power cord usage. (Resolution 1226D) Approved 3-0

101. Authorize the interim executive director to renew the port’s property insurance coverage? The $450,120 in property insurance will be through the broker Alliant Insurance Company of Newport Beach, Calif., for the period 7/1/09 through 7/1/10. The previous premium was $379,487. (Consent Agenda C) Approved 3-0

102. Authorize the interim executive director to sign a $50,000 contract (amendment 16) with Anchor Environmental of Seattle for the Whatcom Waterway and Marina Project? These funds will be used for the proposed NOAA homeport relocation in Bellingham. This amendment brings the approved contact to $5,416,487 and the total authorized contract to $5,424,319. (Consent Agenda D) Approved 3-0

103. Correct errors in the original contingency fee and total contingency fee for the Olympic Coordination Center? See the 6/16/09 meeting, vote number 98, for the correct figures. (Consent Agenda E) Approved 3-0

104. Authorize the interim executive director to sign an agreement with the city of Bellingham for the Roeder Avenue/Bellwether Way intersection improvement project? The agreement requires a traffic signal or roundabout at the intersection prior to the city issuing a certificate of occupancy for a second building at Bellwether Gate. The port will pay the city a public facilities construction agreement fee of $1,613. The estimated completion date for the project is 5/31/10. (Consent Agenda F) Approved 3-0

105. Authorize the interim executive director to sign a $60,200 change order with Tiger Construction of Bellingham for the Bellingham airport rescue and fire fighting building? The additional money will repair the road to the building. The original contract and contingency fee for $2,143,935 was approved at 6/17/08 meeting, vote number 86. This vote brings the total amended contract to $2,204,135. (Consent Agenda H) Approved 3-0

106. Authorize the interim executive director to sign a $5,796 contract (amendment #3) with KPFF Consulting Engineers of Seattle for the design and engineering of the Blaine boat launch replacement project? The original contract for three projects was approved at the 4/1/08 meeting, vote number 52. This amendment is for pile and float replacements. It increases the total authorized amount to $108,796. (Consent Agenda I) Approved 3-0

107 Authorize the interim executive director to sign a $7,500 contract (amendment #3) with RMC Architects of Bellingham to estimate the cost of construction and installation of signage at the Waterfront Innovation Zone? The original contract for $195,100 was approved at the 9/2/08 meeting, vote number 111. This amendment increases the total authorized amount to $227,960. (Consent Agenda J) Approved 3-0

108. Authorize the interim executive director to accept a $90,200 state grant for the Bellingham Bay Demonstration Pilot project? The money funds eelgrass seeding at the log pond and habitat restoration at Squalicum Creek. The Bellingham Bay Demonstration Pilot project was was initiated in 1996. The original completion deadline was 6/30/02. At the 12/17/02 meeting, vote number 120, the deadline was extended to 6/30/05. At the 6/7/05 meeting, vote number 68, the deadline was extended to 6/30/07. At the 9/5/06 meeting, vote number 99, the deadline was extended to 6/30/09. The new deadline is 6/30/11. Total grant money for the Bellingham Bay Demonstration Pilot project is $572,250 of which $197,299 is yet to be spent. (New Business 1) Approved 3-0

109. Authorize the interim executive director to sign a $25,866 contract with Argus Pacific of of Seattle to perform a hazardous building materials survey at the former Georgia Pacific mill property? The company will survey 10 structures for hazardous materials (asbestos, e.g.), prepare a report summarizing the findings and make recommendations for abatement. A contingency fee of $2,587 brings the total contract to $28,453. (New Business 2) Approved 3-0

110. Approve supplemental agreement six1 with the city of Bellingham for The Waterfront District in the amount of $332,500? The Waterfront District is the new name for the former Georgia-Pacific property that was initially called New Whatcom. The city also contributed $332,5000 for a total of $665,000 for the master plan, supplemental and final environmental impact statement. The Bellingham City Council approved supplement agreement six at the 6/29/09 meeting, vote number 137. (New Business 3) Approved 3-0

111. Authorize the interim executive director to sign an $80,000 contract (amendment 9) with Blumen Consulting Group of Kirkland to complete an addendum to the draft supplemental environmental impact statement for The Waterfront District redevelopment project? A contingency fee of $10,465 increases authorized expenditures to $943,705. (New Business 4) Approved 3-0

112. Authorize the interim executive director to award the low bid of $238,130 to Razz Construction of Bellingham to complete landfill cover improvements at the Bellingham airport woodwaste landfill? The landfill began operation by Georgia-Pacific in 1984 and was closed in 1992. The port assumed responsibility for the landfill as part of the G-P land acquisition. The landfill is listed by the state of Washington as a hazardous waste site. Leachate from the landfill is currently being trucked to the G-P treatment lagoon. The port plans on closing the treatment lagoon to leachate dumping and turning it into a marina. Bennett Engineering is working on a plan to construct a pump station and dispose of treated leachate in the city of Bellingham’s sewer system. A contingency fee of $35,720 brings the total contract to $273,850. Approved 2-0, Douglas Smith recused himself. Razz Construction is Mr. Smith’s tenant; counsel advised Mr. Smith that wasn’t a conflict of interest. (New Business 5) Approved 3-0

113. Authorize the interim executive director to sign a $32,000 contract (amendment 1) with Transpo Group of Kirkland to provide an airport traffic impact analysis? This analysis is part of two site plans the port is required to submit to the county before the port can lease property. This vote brings the total authorized amount $45,300. (New Business 6) Approved 3-0

114. Authorize the interim executive director to sign a $74,660 contract with Berger/ABAM Consulting Engineers of Federal Way for the phase 1 inspection of the Blaine and Squalicum Sawtooth Piers? The first phase will be the evaluation and cost estimates for improvements to piling, bulkheads, pier support structure and decks. A contingency fee of $7,466 brings the total contract to $82,126. (New Business 7) Approved 3-0

1This vote brings the port’s total to $1,617,634 and the grand total for the city and port to $3,183,278. The initial agreement was approved at the 12/14/04 meeting. Supplement #1 for $53,165 was approved at the 7/18/06 meeting vote number 93; supplement #2 for $332,118 was approved at the 12/12/06 meeting, vote number 138; supplement #3 for $402,818 was approved at the 3/6/07 meeting, vote number 39, supplement #4 for $352,413 at the August 21, 2007 special meeting, vote number 92 and supplement #5 for $144,620 at the 11/20/07 meeting, vote number 129.
