Action Taken at November 5, 2013 Meeting

Shall the commission:

152. Authorize the executive director to sign a $26,269 contract (amendment #33) with Anchor QEA of Seattle for the phase 1 of the Whatcom Waterway cleanup project? This amendment is for flow testing of the discharge effluent to determine appropriate permit limits of turbidity at the former GP treatment lagoon. The project may be eligible for Model Toxics Control Act funding. A contingency fee of $5,254 brings this amendment to $31,523 the total contract to $8,374,451. (2746/Consent Agenda 3) Approved 3-0

153. Shall the Port of Bellingham continue working with the city of Bellingham and Whatcom County and hire a governmental affairs consultant? In 2013, the three agencies hired the consulting firm McBride Public Affairs of Olympia to represent the interests of the city/county/port on state legislative issues. At the 12/3/2013 meeting, the commissions approved the agreement to hire the consulting firm for another year. (2751/Action Item 1) Approved 3-0

154. Authorize the executive director to sign a $300,000 contract (amendment #2) to Strider Construction Company of Bellingham for the caustic plume/cell building remedial action? The contract includes: removal, stabilization and transportation to appropriate landfills of mercury-contaminated soil from the former GP property; demolition of the cell building and the backfill and paving of excavation sites. This amendment brings the total contract to $3,683,754 (2736/Action Item 2) Approved 3-0

155. Authorize the executive director to sign a $373,100 contract (amendment #3) with BergerABAM of Federal Way for phase 2 of the Harris Avenue pier replacement and Fairhaven shoreline rehabilitation projects? At the 3/6/2007 meeting, vote #32, the commission approved a contract with BergerABAM for a predesign report on the Harris Avenue shipyard redevelopment project. The contract for phase 1 was approved at the 5/3/2011 meeting, vote #77. This amendment brings the total contract to $554,150. (2737/Action Item 3) Approved 3-0

156. Authorize the executive director to sign a $25,760 contract with Faith Group LLC of St. Louis, Missouri for airport consulting services? The port is going to install a multiple user passenger processing system. The system allows airlines to use any ticket agent and/or boarding gate without having to assign a gate to any single airline. (2738/Action Item 4) Approved 3-0

157. Approve a lease with three acupuncture businesses for suite 219 at the Bayview Center Building? Bellingham Medical Acupuncture, Inner Landscape Acupuncture and A Better Way Massage d/b/a/ Bellwether Medical Acupuncture will lease 1,300 square feet for two years and 16 days. The lease can be renewed for three consecutive two-year periods. (2739/Action Item 5) Approved 3-0

158. Amend the lease (amendment #2) with Bellwether Gate LLC for Building D at Bellwether on the Bay? The vote at the 10/19/2010 meeting, vote #142, required construction to begin on Building D at or before 11/1/2013. Due to market conditions the commencement date for construction is being moved to 5/1/2015 and completion by 10/31/2016. (2740/Action Item 6) Approved 3-0

159. Modify a lease with Nautigirl Brands because it is struggling financially? Nautigirl Brands leases a kiosk on the Plaza at Bellwether. The lease is being reduced from $1,000 to $500 per month. If the port secures a new tenant for the kiosk, the lease with Nautigirl Brands will be terminated. (2741/Action Item 7) Approved 3-0

160. Allow the Hempler Foods Group (formerly. B. B. Meat and Sausage Company) to sell up to $10 million in tax-free bonds for improvements and equipment to expand its meat processing facility in Ferndale? (Public hearing held; commission acting as the Industrial Development Corporation.) At the 2/15/2005 meeting, vote number 31, the port commission allowed B.B. Meat and Sausage to sell $4 million in tax-free bonds for the new facility and at the 7/18/2006 meeting, vote #89, voted to allow Hempler Group to sell up to $6,125,000 in tax free bonds for the facility in Ferndale. 2742/ Action Item 8 (Industrial Development Corporation Resolution 75) Approved 3-0

161. Support the IDC resolution allowing Hempler Foods to sell up to $10 million in tax free bonds? See previous vote for details. 2743/Action Item 8 (Resolution 1325) Approved 3-0

162. Send a letter to Bellingham Mayor Kelli Linville outlining the level of support by the Port of Bellingham for the acquisition of a fire boat? At the Bellingham City Council meeting on 10/28/2013, vote #232, the council authorized the mayor to accept a $750,000 federal grant for the purchase of a firefighting vessel? The U.S. Department of Homeland Security grant requires $250,000 in local matching funds. The city sold the previous firefighting boat in late 2011; city staff said expenses in maintaining the aging boat could not be justified. On 3/30/2012, less than six months after the boat was sold a Squalicum Harbor fire killed two people and destroyed 12 boats. The letter to the mayor indicated that the port would pledge half the matching funds ($125,000) and provide moorage for the vessel. (2743/Action Item 9) Approved 3-0

163. Incorporate the capital projects contained in the 2014 strategic budget into the Comprehensive Scheme of Harbor Improvements? (Public hearing held) The harbor improvements are: Blaine wharf district master plan; Sumas international cargo terminal; Bellingham airport master plan; Squalicum Harbor improvements; Bellingham Shipping Terminal master plan and Fairhaven Harbor improvements. 2761/Action Item 1 (Resolution 1326) Approved 3-0

164. Adopt the 2014 strategic budget? Public hearing held. 2753/Action Item 2 (Resolution 1323) Approved 3-0

165. Adopt the 2014 property tax levy? The 2014 property tax levy is .2861 cents per $1,000 of assessed valuation and tax income is estimated at $6,719,000. The revenue is believed to be the same as the 2013 property tax levy. When the county assessor provides a final property assessment, staff will prepare a modified resolution. 2753/Action Item 2 (Resolution 1324) Approved 3-0

166. Authorize the executive director to sign $1,913,529 in contracts to implement the 2014 employee benefits program? There is no rate increase for 2014. The port's share is: $1,681,053 for medical; $166,333 for dental and vision; $17,787 for life/accidental death/dismemberment; $21,937 for long-term disability and $2,823 for employee assistance. The employees monthly share for families is $118.18. There is a broker fee of $27,234. (2754/Action Item 3) Approved 3-0

167. Authorize the payment of $49,894 to the state of Washington for two aquatic lands harbor leases? The state issued two leases to Georgia-Pacific for the treatment lagoon known as the Aerated Stabilization Basin. The leases are for a pipeline under Whatcom Creek to the treatment lagoon for stormwater treatment and the outfall pipe from the treatment lagoon into Bellingham Bay. The treatment lagoon is part of the Whatcom Waterway cleanup site. This payment is for 12/1/2013 through 11/30/2014. (2755/Action Item 4) Approved 3-0

168. Authorize the executive director to sign a $35,500 contract (amendment #9) with Landau Associates of Edmonds to increase the term and scope of the draft cleanup plan for the Cornwall Avenue landfill? At the 7/3/2007 meeting, vote #85, the commission approved a contract with Landau Associates to finalize the remedial investigation/feasibility study of the Cornwall Avenue landfill. The port sold 49 percent of the landfill (11/15/2005 meeting, vote #111) to the city of Bellingham for $2,450,000. The property is located at the foot of Cornwall Avenue. A draft remedial investigation/feasibility study was submitted for public review in August-September 2013. This amendment brings the total contract to $723,110. (2756/Action Item 5) Approved 3-0

169. Authorize the executive director to sign a $17,513 contract (amendment #2) with Bennett Engineering of Bellingham to perform the Bellingham airport woodwaste landfill monitoring and reporting services for 2014? The Whatcom County Health Department issued the permit for the closure of the woodwaste landfill site (12/7/2010 meeting, vote #165). It is anticipated that woodwaste post-closure monitoring, water sampling and reporting will be required for 15 to 20 years. Bennett Engineering will conduct monthly landfill cover inspections, perform quarterly water sampling, gas monitoring and file quarterly reports. Bennett will also do sampling and reporting as required by the National Pollution Discharge Elimination System. This amendment brings the total contract to $170,567. (2762/Agenda Item 6) Approved 3-0

170. Authorize the executive director to award the low bid of $1,771,441 to IMCO General Construction of Ferndale for multiple marine projects? The six projects are: structural repairs at the Bellingham Shipping Terminal, pier repair in Blaine, replacing pier piles on Harris Avenue, structural repairs at the Gillnet loading dock, dolphin repairs at the Bellingham Cruise Terminal and pier debris removal at the Bellingham Shipping Terminal.The work was advertised and three bids were received. A contingency fee of $100,000 brings the total contract to $1,871,441. (2757/Action Item 7) Approved 3-0

171. Authorize the executive director to sign a $19,500 contract (amendment #8) with KPFF Consulting Engineers of Seattle to provide additional mooring analysis for the shipping terminal bulkhead and main pier repair/replacement project? Amendment #8 involves four tasks at the south dock and one at the north dock. This amendment brings the total contract to $426,282. (2758/Action Item 8) Approved 3-0

172. Authorize the executive director to sign a $605,199 contract with Air-Transport IT Services of Orlando, Florida, for a multiple user passenger processing system? The system allows airlines to use any ticket agent and/or boarding gate without having to assign a gate to any single airline. The software will allow airlines to make passenger processing a smooth operation. The contract covers 36 work stations, necessary servers and hardware plus installing and maintaing the system. The engineer’s estimate cost was $700,000. A contingency fee of $60,520 bring the total contract to $665,719. (2759/Action Item 9) Approved 3-0

173. Adopt annual changes to the rules, regulations and procedures for Blaine and Squalicum Harbor? The housekeeping measure incorporates new multiparty boathouse insurance requirements calling for owners to carry a $3 million policy for property damage and death and/or bodily injury. The resolution runs from 11/19/2013 through 1/31/2015. (2760/Action Item 10 (Resolution 1226-J) Approved 3-0
