Action Taken at December 3, 2013 Meeting

Shall the commission:

174. Annul the Snow Removal Systems, Inc. account in the amount of $11,419? The balance consists of rent and utilities for 4/2012 through 10/2012 and late fees through 11/2013. The company signed a month to month lease agreement with the port in October 2003, and the lease was terminated on 11/30/2012. The write-off balance of $11,419 will be recorded as uncollectible revenue in the real estate division. (2777/Consent Agenda C) Approved 3-0

175. Authorize the executive director to sign a $8,580 contract (amendment #7) with Anchor QEA of Seattle to perform archeological monitoring for the Squalicum Creek restoration project? This project will help restore Bellingham Bay. At the 7/6/2010 meeting, vote #103, Anchor QEA (formerly Anchor Environmental) was authorized to produce a conceptual plan for major components of the project: habitat enhancement of the creek estuary, modification of two bridges, removal of the concrete bottom between the two bridges and replacement of a sewer trunk line. Construction of phase one began on 10/14/2013 and is expected to be completed by the end of the year. At this point, approximately $1,785000 has been secured by grants by the port. A contingency fee of $858 brings this amended contract to a total of $592,025. (2775/Concent Agenda F) Approved 3-0

176. Approved the Waterfront District Master Plan as defined in the 2005 interlocal agreement? The Bellingham City Council reviewed and approved the package of documents with eight changes to the documents. Changes include language updates to the SubArea Plan, edits to correct mode shift percentages, format corrections, exhibit references affordable housing goals and living wage goals; additions incorporated into the set of documents before the commission for approval. The commissioners discussed the changes generally and there was some discussion about the living wage job goal addition to the development agreement. 2785/2786/2787/2788/2789/2790 Action Item 1 (Resolution 1327) Approved 3-0

177. Amend the Squalicum Harbor comprehensive scheme of harbor improvement? The city is transferring certain real property currently platted as streets to the Port of Bellingham. The properties in question are the full width of Hilton Avenue between the Southwesterly line of Maple Street to the inner harbor line; a parcel of land at the South-Western corner of the intersection of Hilton and Roeder Avenue; and the full width of vacated C Street between the southwesterly line of W. Laurel Street and the Inner Harbor Line. 2780/2781/2782/2783/2784 Action Item 1 (Resolution 1328) Approved 2-1, Mike McAuley opposed.

178. Authorize the executive director to sign an lease agreement with the city of Bellingham and Whatcom County for an emergency operations center? There is not adequate space in the county to quickly assemble an efficient center. The port-owned facility was used by the federal government during the 2010 Winter Olympics  and was eventually abandoned. Now the county and city want to share a portion of that building at the Bellingham airport to develop emergency management and responses. The county and city will pay the port $67,106 each for three years and they are responsible for maintenance and repair and retain a right to purchase the building. The 10-year contract expires on 12/31/2023. (2766/Action Item 2) Approved 3-0

179. Authorize the executive director to convey the ownership of port signage located on state and city’s properties to the state and city, respectively? The port paid for the design, fabrication and installation of way finding signs along Interstate 5, State Route 11 and with the city of Bellingham, The maintenance, liability and ownership of these signs will be transferred to the city of Bellingham and the state of Washington. (2769/Action Item 4) Approved 3-0

180. Authorize the executive director to sign a $28,324 contract (amendment #3) with Coast & Harbor Engineering of Edmonds to complete level drawings for the Little Squalicum Beach improvement project? The work is being done on the northwesterly bank of the artificial shoreline adjacent to Mt. Baker Plywood. The site has been identified as a priority for habitat restoration. The original contract was approved at the 4/5/2011 meeting, vote #60. This amendment brings the total contract to $113,794. (2770/Action Item 5) Approved 3-0

181. Authorize the executive director to sign an $150,000 contract (amendment #2) with Glidepath, LLC of Grand Prairie, Texas, for the baggage handling system at the Bellingham airport? The checked baggage inspection system is for inbound and outbound baggage. The structure includes an explosive detection system, support equipment and two inbound baggage carousels. The Transportation Security Administration is requiring changes to the system. The federal government will reimburse the port for 95 percent of the costs. A contingency fee of $43,829 brings the total contract to $3,896,564. (2771/Action Item 6) Approved 3-0

182. Authorize the executive director to sign an agreement with Whatcom County and the city of Bellingham to jointly fund economic development services? Economic development services are: business retention, expansion, recruitment, assistance and supporting research. The port is committed to contribute $66,250, the city $66,250 and Whatcom County $132,500 for a total of $265,000 for the first year of the three-year agreement. (2772/Action Item 7) Approved 3-0

Action Take at December 17, 2013 Meeting

Shall the commission:

183. Authorize the executive director to sign an agreement (amendment #1) with Whatcom County and the city of Bellingham to hire a legislative consultant?  The port will pay one third ($30,000) of the $90,000 contract with  the consulting firm McBride Public Affairs of Olympia — represented  by Tom McBride and Ben Bucholtz. The company will represent the interests  of the city/county/port on state legislative issues,  identify opportunities for staff and elected officials to testify  before legislative committees and/or meet with members of the Legislature  and will work with Washington Associations of Cities,  Counties, and Ports in representing local interests. The consulting  firm will prepare the legislative agenda for the upcoming season, research policy, and handle all other  intergovernmental services. (2814/Consent Agenda A) Approved 3-0

 

184. Authorize the sale of one vessel for the nonpayment of moorage fees? An auction is scheduled for January 9 to sell a 44-foot diesel concrete sailboat with a moorage fee of $3,029. (2823/Consent Agenda B) Approved 3-0

185. Renew a lease with Leap Frog Water Taxi for office and moorage space at the Bellingham Cruise Terminal? The taxi is a 32 foot aluminum passenger vessel that carries 20 passengers and serves San Juan Islands that have no ferry service. Trips are scheduled on a custom basis. One way trips to popular destination vary from $35 to $130 and rounds trips from $70 to $260.The lease will run from 10/1/2013 to 9/30/2015. (2815/Consent Agenda C) Approved 3-0

186. Authorize the executive director to spend $41,856 to purchase software from Entrance Controls of Tukwila for the Bellingham airport parking lots? The sole-source justification form listed Entrance as the exclusive state vendor for the equipment. ScanNet is the revenue management system used at the pay parking lots. It is maintained by Windows XP and the platform will not supported by Microsolf after April 2014. ScanNet will be upgraded to Windows 7, new software and software licenses will be acquired. (2826/Action Item 1) Approved 3-0

187. Authorize the executive director to sign a $63,000 contract (amendment #3) with Landau Associates of Edmonds to conduct a remedial investigation/feasibility study of the Westman Marine site in Blaine? Previous environmental investigations have documented metal contamination in marine sediment. This amendment requires excavation and proper disposal of contaminated soils discovered at a construction that overlapped the study site boundary. The state has listed the site at the top of the Model Toxics Control Act priority list. The original contract for $132,000 was approved at the 10/4/2011 meeting, vote #149. This amendment brings the total contract to $631,700. (2827/Action Item 2) Approved 3-0

188. Authorize the executive director to sign a $39,300 contract with Fairbanks Environmental Services of Bellingham to perform a forage fish study of inner Bellingham Bay? The state funded study (7/16/2013 meeting, vote #120) will document the presence or absence of surf smelt and Pacific sand lance spawning at nine potential sites beach sites between Little Squalicum Creek and Fairhaven Shipyard. The study will include monthly surveys for a period of 20 months. (2816/Action Item 3) Approved 3-0

189. Authorize the executive director to sign a $97,713 contract (amendment #17) with Aspect Consulting of Seattle for construction management oversight and compliance monitoring of the caustic plume/cell building interim action project? This is the second phase of the of the interim action which includes the removal, stabilization and disposal of soil impacted with elementary mercury. This amendment brings the total contract to $2,866,133. (2825/Action Item 4) Approved 3-0

190. Authorize the executive director to sign a $1,100,000 contract (amendment #3) to Strider Construction Company of Bellingham for the caustic plume/cell building remedial action project? This contract includes: removal, stabilization and disposal of approximately 800 tons of mercury-contaminated soil and stabilize the soil for the former GP property. This amendment brings the total contract to $4,783,746 (2817/Action Item 5) Approved 3-0

191. Authorize the executive director to sign a $62,441 contract (amendment #1) with Associated Project Consultants of Bellingham to provide engineering and bidding support for the installation of a fire sprinkler system at Squalicum Harbor? A boathouse fire on 3/30/2012, killed two people and twelve boats were destroyed. At the 9/24/2012 meeting, vote # 187, the Bellingham City Council approved a marina boathouse chapter to the Bellingham Fire Code. The new code outlines safety regulations, requires permits and annual inspections of all harbor boathouses and establishes maintenance requirements for handling and storage of combustible materials. In addition, fire alarm and protection systems will be required in all the larger boathouse condominiums. This amendment brings the total contract to $98,616. (2818/Action Item 6)Approved 3-0

192. Authorize the executive director to sign a $20,025 contract (amendment #9) with URS Corporation of San Francisco to perform conceptual programming and cost estimates for the Bellingham airport expansion project? URS has been involved in the design of the building and performed construction administration for the terminal expansion project. This amendment will add the United States Customs and Border Protection Agency to the terminal building. The original contract was approved at the 3/3/2009 meeting, vote #47. This amendment brings the total contract to $5,877,522. (2819/Action Item 7) Approved 3-0

193. Authorize the executive director to sign a 53,750 agreement with Western Washington University for economic development services? Economic development services are: business retention, expansion, recruitment, assistance and supporting research. The port, city of Bellingham and Whatcom County have been jointly contracting in 2012 and 2013 with WWU. The city will contribute $53,750 and Whatcom County will contribute $107,500 for a total of $215,000. (2820/Action Item 8) Approved 3-0

194. Modify a lease with Bellingham HI, LLC for the Holiday Inn at the Bellingham airport? At the 6/4/2013 meeting, vote #94, the commission approved a lease for a Holiday Inn with 150 rooms, underground parking, workout room, meeting space and restaurant to be constructed on approximately 3.8 acres at the intersection of West Bakerview and Airport Drive at an estimated cost of $19-20 million. This lease modification with add approximately 39,640 square feet for additional parking and to expand the meeting/banquet/restaurant facilities. (2822/Action Item 11) Approved 3-0

195. Authorize the executive director to sign all documents between the Wood Stone Corporation and HPC Investments? The Wood Stone Corporation located at the Bellingham airport manufactures wood-fired and gas ovens for restaurants.The company has been purchased by the Henny Penny Corporation located in Eaton, Ohio. This vote allows Wood Stone to transfer stock between two parties. The lease with the Wood Stone Corporation expires on 5/31/2015. Wood Stone will remain the lessee and be responsible for payment of rents. (New Business 1) Approved 3-0
