Action Taken at April 1, 2014 Meeting

Shall the commission:

44. Approve an event and site use agreement with Allied Arts of Whatcom County for the 2014 Bellwether Arts Market? This is the third year of the market. The port will pay Allied Arts $13,360 to produce the Bellwether Arts Market. In 2012 and 2013, the market was be open each Sunday in August at the Tom Glenn Common. This year, it will be a three-day weekend event from August 15-17 at the same location. The event will have booths with arts, crafts, local vendors, face painting and live music. No alcohol can be sold or consumed at the event and no pyrotechnic devices will be allowed. (3099/Consent Agenda C) Approved 3-0

45. Approve an event and site use agreement with The Jazz Project for the 2014 Bellwether Jazz Festival? The port will pay The Jazz Project $10,000 to produce a free public concert at the Tom Glenn Common. The first Bellwether Jazz Festival was produced in 2011. The 2014 festival will be Saturday, September 6, from noon to 8 p.m. Beer and wine will be sold, no pyrotechnic devices will be allowed. (3100/Consent Agenda D) Approved 3-0

46. Authorize the executive director to sign $299,343 contract (amendment #3) with Pacific Security (formerly Whatcom Security Agency) of Bellingham for security services? This amendment will increase the billing rate by 3 percent. The contract runs from 6/1/2014 to 5/31/2015. (3101/Consent Agenda E) Approved 3-0

47. Authorize the executive director to sign a memorandum of understanding with the city of Bellingham for potential use of a proposed fire boat? At the Bellingham City Council meeting on 10/28/2013, vote #232, the council authorized the mayor to accept a $750,000 federal grant for the purchase of a fire fighting vessel. The U.S. Department of Homeland Security grant requires $250,000 in local matching funds. The city sold the previous fire fighting boat in late 2011; city staff said expenses in maintaining the aging boat could not be justified. On 3/30/2012, less than six months after the boat was sold a Squalicum Harbor fire killed two people and destroyed 12 boats. The port pledged half the matching funds ($125,000) and will provide moorage for the vessel. This memorandum requires the port to notify the Bellingham Fire Department of any need to enhance waterside security. (3102/Consent Agenda F) Approved 3-0

48. Modify a lease with Bellingham HI, LLC for the Holiday Inn at the Bellingham airport? At the 6/4/2013 meeting, vote #94, the commission approved a lease for a Holiday Inn with 150 rooms, underground parking, workout room, meeting space and restaurant to be constructed on approximately 3.8 acres at the intersection of West Bakerview and Airport Drive at an estimated cost of $19-20 million. At the 12/17/2013 meeting, vote #194, a lease modification added approximately 39,640 square feet (4.89 acres) for additional parking and to expand the meeting/banquet/restaurant facilities. This modification transfers the payment of water and sewer services from the port to the city of Bellingham. (3105/Consent Agenda I) Approved 3-0

49. Settle property damage claims with six boat owners and their insurance carriers? The total settlement to be paid to the port is $770,000. The six boat owners signed mutual partial release and settlement agreements. At the 2/18/2014 meeting, vote #28, the port recovered $675,000. The total property loss to date is approximately $1,824,738. The port insurance carriers have paid this loss less the port deductible of $125,000, (3106/ Action Item 1) Approved 3-0

50. Approve the 2014 Bellingham airport tariff schedule? Staff recommended two changes to the schedule. Increase Main Terminal parking lot fees from $10.00 per day to $12.00 per day and decrease the economy lot a daily rate from $9.00 per day to $8.00; the same as economy lots b and c. Occupancy rates in the main lot is 73 percent, economy lot a is 21 percent, economy lot b is 6 percent and economy lot c is empty most of the year, except during the month of March. The changes anticipate an additional $500,000 per year in revenue. (3107/Action Item 2) Approved 3-0

51. Authorize the executive director to award the only bid of $136,187 to Marina Accessories of Bellingham for fabricated and treated lumber for Gate 5 C and D floats? The float structutal upgrade project will replace and upgrade damaged and deteriorated structural components to provide reliable moorage. Usually a contractor would purchase the lumber but a long lead time is required for fabricated treated wood so port staff purchased the lumber. A contingency fee of $10,000 brings the total authorized amount to $146,178. (3108/Action Item 3) Approved 3-0

52. Authorize the executive director to sign the boathouse agreement with Blaine Moorage Association II? At the 11/19/2013 meeting, vote #173, the commission approve changes to the rules, regulations and procedures for Blaine and Squalicum Harbor. It adopted new multiparty boathouse insurance requirements calling for owners to carry a $3 million policy for property damage and death and/or bodily injury. There are seven multiparty boathouses, five in Squalicum and two in Blaine. This is the first group to sign an agreement with the port. (3109/Action Item 4) Approved 3-0

Action Taken at April 15, 2014 Meeting

53. Authorize the executive director to sign a $40,950 contract (amendment #2) with Cardno TEC of Charlottesville, VA, to increase the scope of consulting services for the environmental compliance assessment program? The program began in 1992; the port started looking more closely at the impact of the port and tenant operations on port properties. Approximately 80 tenants are subject to some form of environmental regulation; the port regularly inspects these tenants. This amendment brings the total contract to $133,342 and extends it through 4/30/2015. (3129/Consent Agenda B) Approved 3-0

54. Adopt the scope and schedule for the 2014 moorage model? The scope and schedule provides direction to the Marina Advisory Committee regarding the moorage model review; the committee will provide recommendations to the commission. (3130/Consent Agenda C) Approved 3-0

55. Authorize the executive director to sign a $6,375 contract with Spinner LLC of Bellingham for the live streaming of regular commission meetings and archiving the meetings on the website for future viewing? It will cost $425 per commission meeting and up to four-and-one-half hours will be recorded. (3136/Action Item 1) Approved 3-0

56. Authorize the executive director to sign a $284,715 contract (amendment #3) with Floyd/Snider of Seattle to complete a remedial investigation/feasibility study at the Harris Avenue shipyard? The Harris Avenue shipyard site includes upland and aquatic land that is currently used for shipyard and boat manufacturing operations. The port entered into an agreement with the Department of Ecology in 2002 to perform a remedial investigation/feasibility study for contaminated marine sediments under the Model Toxics Control Act. A draft sediments remedial investigation/feasibility study was completed in 2004. The original remedial investigation/feasibility study contract was approved at the 5/6/2008 meeting, vote #66, it has been interrupted by a series of state delays. The study is back on track and is expected to issue the draft RI/FS, draft cleanup action plan and draft consent decree later this year. This amendment brings the total contract to $1,414,305. (3132/Action Item 2) Approved 3-0

57. Authorize the executive director to accept a $150,000 state grant to support redevelopment of the log pond and the Shipping Terminal? At the 3/4/2014 meeting, vote #35, the commission authorize the executive director to sign a memorandum of agreement with the state of Washington to join the Washington Brownfields Coalition in support of cleanup and redevelopment of contaminated properties in Whatcom County. The grant money will be used to attact and recruit new and/or expanding businesses to the log pond and Shipping Terminal area. (3134/Action Item 4) Approved 3-0

58. Approve the lease agreement with Bellwether Market for 867 square feet at 8 Bellwether Way? The one-year lease beginning 5/1/2014 and ending 4/30/2015 can be renewed nine times. The market will be a high-end convenience store similar in concept to the ABC Stores that are popular in Hawaii. It will carry boaters’ needs, speciality wines, meats, cheeses, sandwiches and salads. The one-year rent is $18,207. (3133/Action Item 4) Approved 3-0
