Action Taken at May 5, 2014 Meeting

Shall the commission:

59. Authorize the executive director to accept two state grants totaling $2.5 million for the design and construction of stormwater control improvements at the Bellingham Shipping Terminal and the Bellingham Marine Trades area? A grant for $1.5 million will be for the Bellingham Shipping Terminal and a grant of $1 million for the Bellingham Marine Trades area. (3163/Consent Agenda C) Approved 3-0

60. Authorize the sale of one vessel for the nonpayment of moorage fees? An auction was scheduled for June 10, a 22-foot fiberglass sailboat had unpaid moorage fees of $1,019. The auction was cancelled when the fee was paid. (3164/Consent Agenda D) Approved 3-0

61. Approve a land lease with The Landings at Colony Wharf? Chevron donated the property at 1020 C Street to the port; see the 11/2/2004 meeting, vote #109. The property is part of the old Roeder garbage dump. At thhe 9/5/2006 meeting, vote #102, The Landings at Colony Wharf entered into a harbor land lease for approximately 3.52 acres of land; the lease expired on 1/31/2012 and been on a month-to-month basis since. The port will be conducting a remedial investigation/feasibility study during the lease period. The lease commence on 5/1/2014 and terminate on 4/30/2024. (3167/Action Item 1) Approved 3-0

62. Authorize the executive director to sign the 2014 – 2016 collective bargaining agreement with the International Longstore and Warehouse Union (ILWU) Local 7, Maintenance? The contract runs from 1/1/2014 through 12/31/2016 and for 2014 contains a wage increase of 3 percent for levels 1 through 5, 4 percent for level 6 and a 2.5 percent quarterly lump sum in lieu of a wage increase for level 7 and a 2.5 percent increase for all levels in 2015 and 2016. (3168/Action Item 2) Approved 3-0

63. Authorize the interim executive director to sign a $32,000 contract (amendment #15) with Landau Associates of Edmonds to complete the remedial investigation/feasibility study of the Weldcraft site? This amendment includes a draft cleanup action plan; supplemental testing, analysis and data reporting for public review and comment later this year. This vote brings the total contract to $501,700. (3169/ Action Item 3) Approved 3-0

64. Authorize the executive director to sign a $90,415 contract (amendment #10) with URS Corporation of San Francisco, CA, for a room design and construction plans at the Bellingham airport? The room is part of the United States Customs and Border Protection Agency facility within the airport terminal building. The original contract was approved at the 3/3/2009 meeting, vote #47. This amendment brings the total contract to $5,977,000. (3170/Action Item 4) Approved 3-0

65. Authorize the executive director to sign a $32,273 contract (amendment #11) with URS Corporation of San Francisco, CA, to provide architectural design for minor build-out additions within the Bellingham airport terminal building? This amendment includes retrofitting the waste water dump facility water lines, adding security cameras and alarms for the federal government and adding a play area to the gate lobby. The original contract was approved at the 3/3/2009 meeting, vote #47. A contingency fee of $2,727 brings this amendment to a total of $6,012,000. (3171/Action Item 5) Approved 3-0

66. Authorize the executive director to sign a $50,900 contract with Kennedy/Jenkins Consultants of Federal Way to provide initial consulting services for the Bellingam Shipping Terminal stormwater improvement project? The port was awarded a $1.5 state grant for the stormwater improvement project; see vote #59. A contingency fee of $5,100 brings the total contract to $56,000 (3172/Action Item 6) Approved 3-0

67. Authorize the executive director to sign a $24,500 contract with Reid Middleton, Inc. of Everett to perform engineering services for the Fairhaven boat launch float and piling replacement project? The existing float is anchored by one timber and three steel pilings. Existing floats will be replaced and the concrete boat ramp repaired. This is the first phase of a three phase program. The first phase is for engineering support to be used in a submittal for grant funding. A contingency fee of $2,450 brings the total contract to $26,950. (3173/Action Item 7) Approved 3-0

68. Authorize the executive director to sign a $59,880 contract (amendment #35) with Anchor QEA of Seattle for phase 1 of the Whatcom Waterway cleanup project? This amendment includes completetion of the National Pollutant Discharge Elimination System permit renewal, completing inspection of the stormwater collection and discharge system and an attempt to obtain rail service to the Port of Bellingham by the Burlington Northern Santa Fe railroad. The project may be eligible for Model Toxics Control Act funding. A contingency fee of $5,988 brings this amendment to $65,868 and the total contract to $8,440,319. (3174/Action Item 8) Approved 3-0

Action Taken at May 20, 2014 Meeting

Shall the commission:

69. Transfer a lease from the Upper Skagit Indian Tribe to Sound Pacific Seafoods? At the 11/3/2009 meeting, vote #165, the commission appprove a lease with the Upper Skagit Indian Tribe for property located at 245 Marine Drive in Blaine. The tribe purchased fish for their processing facility in LaConner. Sound Pacific Seafoods, a new business will use the facility to purchase crab and other seafood (3197/Consent Agenda C) Approved 3-0

70. Authorize the executive director to amend four state grants? The Whatcom Waterway grant will be reduced by $3,290,000. The Blaine Marine grant will be increased by $375,000; the GP West grant increased by $2,971,472 and the Westman Marine grant increased by $102,000. (3199/Consent Agenda D) Approved 3-0

71. Approve the 2014 Bellingham airport tariff schedule? Annual airport parking revenue is $6.25 million or 72 percent of the total budget for the airport. More than six off-site airport parking lots are decreasing revenue for port parking lots. The port has experienced a reduction of approximately 28 percent or $1.75 million per year. Staff is recommending a $3.00 per day reduction from $8.00 to $5.00 in economy parking lots B and C. The parking lot reduction will reduce revenue by approximately $494,000 per year. (3200/Action Item 1) Approved 3-0

72. Update the marina model for moorage rates at Squalicum and Blaine Harbors? This vote updates Resolution 1293, passed at the 2/15/2011 meeting, vote #30. The Marina Advisory Committee unanimously passed a motion on 5/14/2014 incorporating the changes in the upated moorage model version 3.0. 3201/Action Item 2 (Resolution 1330) Approved 2-1, Michael McAuley opposed.

73. Authorize the executive director to sign a $282,357 contract with The Resource Group of Renton for computer services? Some of the software purchased in the early 1990s is not Windows compliant, requiring the information to be transferred every month manually. Microsolf Dynamics GP will be used to intergate the port’s financial, marine management, work orders and real estate software. (3203/Action Item 4) Approved 3-0

74. Authorize the executive director to sign a consent degree with the state of Washington for the Cornwall Avenue landfill? The landfill is located at the foot of Cornwall Avenue. In December 2013 the state approved the final remedial investigation/feasibility study for the landfill which evaluated four cleanup alternatives and highlighted a preferred alternative (alternative 2) which incorporates the 47,000 cubic yards of dredge material as part of the required environmental cap for the landfill. (3204/Action Item 5) Approved 3-0

75. Authorize the executive director to sign a $113,366 contract (amended) with Anchor QEA of Seattle to complete the remedial investigation/feasibility study (RI/FS) of the I&J Waterway? The waterway is one of the Model Toxics Control Act sites. At the 11/16/2004 meeting, vote #117, the commission approved a contract for the RI/FS project. In 2007, the state temporally suspended the project. At the 3/3/2009 meeting, vote #40, the commission approved a contract with Anchor QEA to complete the study. This amendment will provide support in the drafting of a cleanup action plan and consent decree for the site. This amendment brings the total contract to $616,032. (3205/Action Item 6) Approved 3-0

76. Authorize the executive director to award the low bid of $703,833 to Razz Constrution of Bellingham for the Squalicum outer harbor improvement project? This contract combines two projects; the Gate 5 C-D float structural upgrade and Gate 3 GE open slip conversion project. The Gate 5 C-D timber and steel structure has deteriorated over time, it will be repaced to provide reliable moorage. The G-East boathouse was destroyed in the March 2012 fire; the owners decided not to rebuild the boathouse. The remaining timber piling wil be removed; concrete floats and piles will be installed. A contingency fee of $70,384 brings the total contract to $774,216. (3206/ Action Item?) Approved 3-0

77. Authorize the interim executive director to sign a $18,000 contract (amendment #19) with Reid Middleton of Everett for the Gate 3 laterals F & G project? This amendment is for construction support services during the construction of the G-East slip conversion project. A contingency fee of $9,500 brings the amendment to $27,500 brings the total amended contract to $1,239,531. (3207/Action Item 8) Approved 3-0

78. Submit a modified zone schedule for Foreign Trade Zone #129 to the U.S. Foreign Trade Zone board? The port administers three general purpose zones (#129 – Bellingham/Whatcom County, #130 – Blaine, 131 – Sumas). The zones allow U.S.-based companies to defer, reduce or eliminate U.S. custom duties on products admitted to the zone. The port recently modified #129 to allow more flexibility and less costly implementation with Whatcom County. (3208/Action Item 9) Approved 3-0
