Action Taken at June 3, 2014 Meeting

Shall the commission:

79. Approve a contract modification with the fed eral government for space at the Bellingham airport? The Department of Homeland Security/Transportation Security Administration contract will increase space from 2,406 square feet to 7,535 square feet for security screeners to conduct screenings of all passengers, property and baggage and increase the reimbursement for janitorial services and electrical consumptions from $19,347 to $61,247. (3224/Consent Agenda C) Approved 3-0

80. Authorize the executive director to award the low bid of $533,663 to Orion Marine Contractors of Tacoma for multiple marine repair projects? The contract covers four projects: (1) replace the Harris Avenue Pier Fender Pile; (2) renovate the Fairhaven Marine Industrial Park haul-out pier; (3) repair the Bellingham Shipping Terminal dolphins and (4) repair the timber fender piling and bullrail at the Squalicum Sawtooth dock. The work was advertised and five bids were received. A contingency fee of $53,366 brings the total contract to $587,029. (3225/Consent Agenda D) Approved 3-0

81. Authorize the executive director to award the low bid of $548,960 to Western Refinery Services of Ferndale for the 2014 asphalt and concrete repair projects? The contract covers projects at Blaine Gate 3 and Gate 1; Bellingham airport, Squalicum Gate 3/webhouse, Marine Park and marine terminals M & R. The work was advertised and three bids were received. A contingency fee of $54,896 brings the total contract to $603,856. (3226/Consent Agenda E) Approved 3-0

82. Authorize the executive director to apply for a state grant to replace the Fairhaven and Squalicum Harbor boat launches? The Fairhaven boat launch provides salt-water access from April through October. The floats were constructed in 1991 and are nearing the end of their useful life. In 2011, the state awarded the port a grant of $478,355 for the Squalicum Harbor boat launch. The state has awarded all the money except $28,519. This application is for the remaining money. 3227/Consent Agenda F (Resolution 1331) Approved 3-0

83. Dissolve the Ethics Committee and adopt the Commission Code of Governance and Conduct? The ethics committee was established at the 8/19/2003 meeting, vote #59, amended at the 4/4/2006 meeting, vote #50, the 6/5/2007 meeting, vote #72 and the 2/3/2009 meeting, vote #20. The ethics committee could only offer advice, it had no enforcement power. Processes learned through the Ethics Committee are being integrated into the Commission Code on Governance and Conduct. The code provides integrity and ethical standards for current commissions and their successors. 3221/Action Item 1 (Resolution 1181D) Approved 3-0

Action Taken at June 17, 2014 Meeting

Shall the commission:

84. Approve a supplemental lease agreement with the federal government? At the 7/19/2005 meeting, vote #79, the commission approved a lease with the United States Coast Guard for a stub pier to moor two 87-foot vessels, approximately 1,000 square feet of warehouse space and 1,400 square feet of office space at the Fairhaven Terminal. The lease was for one year with nine renewal options ending on 8/30/2015. This supplemental agreement will extend the lease with one-year renewal options through 9/30/2020. Should the Coast Guard to choose renew the lease for five years the total rent will be approximately $264,804. (3254/Consent Agenda B) Approved 3-0

85. Authorize the executive director to award the low bid of $800,212 to Strider Construction Company of Bellingham for four utility improvement projects? The projects are: add storage capacity to the Alderwood stormwater retention pond ($162,229); replace the four inch Mitchell Way sewer main with an eight inch line ($105,334); replace the “C” Street sewer line between Roeder Avenue and Maple Street ($27,773) and complete Phase 2 replacing water mains and service lines at the Fairhaven Marine Industrial Park ($504,876). The engineer’s estimate was $810,000. The work was advertised and three bids were received. A contingency fee of $99,022 brings the total contrct to $899,234. (3256/Action Item 1) Approved 3-0

86. Authorize the executive director to sign an $82,300 contract (amendment #3) with Associated Project Consultants of Bellingham for construction management and field inspections for Phase 2 of the the Fairhaven Marine Industrial Park project? A new tenant in Building 7 requires increased water pressure, Phase 1 replaced the fire line and increase pressure. Phase 2 will replace the entire fire water main system with new pipe and equipment. Fire hydrants will be replaced with consideration given to changing locations and adding additional hydrants. A contingency fee of $8,230 brings the total amended contract to $194,605. (3257/ Action Item 2) Approved 3-0

87. Authorize the executive director to sign documents required to modify the terms with a port loan with American Nettings and Fabrics? The modification will allow American Nettings to apply for a commercial loan. (3258/Action Item 3) Approved 3-0 88. Amend the lease (amendment #3) with Bellwether Gate LLC for Building D at Bellwether on the Bay? The vote at the 10/19/2010 meeting, vote #142, required construction to begin on Building D on or before 11/1/2013. Due to market conditions the commencement date for construction is being moved to 5/1/2015 and completion by 10/31/2016. A $30,000 payment is due on 4/1/2014; this amendment extends the payment date to 12/31/2014. (3259/Action Item 4) Approved 3-0
