Action Taken at December 2, 2014 Meeting

Shall the commission:

147. Authorize the executive director to sign a $80,470 contract (amendment #2) with Kennedy/Jenks Consultants of Federal Way to provide additional environmental and engineering design services for the Bellingham Shipping Terminal stormwater improvement project? The original contract was approved at the 5/5/2014 meeting, vote #66. The port was awarded a $1.5 million state grant for the stormwater improvement project. This is the third phase of the work. A contingency fee of $16,094 brings the total amended contract to $174,564 (4888/Action Item 1) Approved 3-0

148. Authorize the executive director to sign a $448,710 contract (amendment #4) with Floyd/Snider of Seattle to complete a remedial investigation/feasibility study at the Harris Avenue shipyard? The Harris Avenue shipyard site includes upland and aquatic land that is currently used for shipyard and boat manufacturing operations. The port entered into an agreement with the Department of Ecology in 2002 to perform a remedial investigation/feasibility study for contaminated marine sediments under the Model Toxics Control Act. A draft sediments remedial investigation/feasibility study was completed in 2004. The original remedial investigation/feasibility study contract was approved at the 5/6/2008 meeting, vote #66, it has been interrupted by a series of state delays. The study is back on track and is expected to issue the draft RI/FS, draft cleanup action plan and draft consent decree in early 2015. This amendment brings the total contract to $1,863,015. (4906/Action Item 2) Approved 3-0

149. Authorize the executive director to sign a $196,666 contract with Aspect Consulting of Seattle for engineering and design of phase 1 of the pulp/tissue cleanup at the GP West site? The 74-acre site is divided into the pulp/tissue and chlor-alkali remedial action units. The 31-acre pulp/tissue unit cleanup includes the removal of petroleum impacted soil, monitored natural attenuation of contaminated groundwater, capping throughout the site to prevent direct contact with contaminated soils and institutional controls to ensure the long-term integrity of the cleanup action. This phase is expected to be completed in 2015 and construction started in 2016. A contingency fee of $19,667 brings the total contract to $216,333. (4890/Action Item 3) Approved 3-0

150. Authorize the executive director to sign a $126,000 contract (amendment #1) with Strider Construction Company of Bellingham for four utility improvement projects? The projects are: add storage capacity to the Alderwood stormwater retention pond; replace the four inch Mitchell Way sewer main with an eight inch line; replace the “C” Street sewer line between Roeder Avenue and Maple Street and complete Phase 2 replacing water mains and service lines at the Fairhaven Marine Industrial Park. The entire amendment is going for cost overruns at the Fairhaven Marine Industrial Park. This amendment brings the total contract to $1,066,000. (4891/Action Item 4) Approved 3-0

151. Authorize the executive director to sign $1,753,453 in contracts to implement the 2015 employee benefits program? The estimated cost for 2015 is $136,480 below 2014. The port’s share is: $1,488,308 for medical; $124,261 for dental and vision; $16,234 for life/accidental death/dismemberment; $21,546 for long-term disability and $2,796 for employee assistance. The employees monthly share for families is $116.51. There is a broker fee of $27,234. (4892/Action Item 5) Approved 3-0

Action Taken at December 16, 2014 Meeting

Shall the Commission:

152. Authorize the executive director to sign a contract not to exceed $30,000 with the law firm of Van Ness Feldman of Washington, D.C./Seattle to continue providing legal counsel to the port with regard to the redevelopment of waterfront properties? The contract runs from 1/1/2015 through 12/31/2015. (4982/Consent Agenda B) Approved 3-0

153. Authorize the executive director to sign agreements with C III Commercial Mortgage? The agreements are necessary for Bellwether Gate LLC to refinance Building A. (4983/Consent Agenda C) Approved 3-0

154. Authorize the executive director to sign one-year contracts for advertising at the Bellingham airport? Airport staff believes that advertising revenue will generate between $10,000 and $25,000 per month. (4980/Action Item 1) Approved 3-0

155. Authorize the executive director to sign a $487,500 contract (amendment #7) with Berger/ABAM of Federal Way to complete design and permitting of the Harris Avenue pier replacement project? At the 3/6/2007 meeting, vote #32, the commission approved a contract with Berger/ABAM for a predesign report on the Harris Avenue shipyard redevelopment project. The contract for phase 1 was approved at the 5/3/2011 meeting, vote #77. The new pier is projected to be operational in June 2016. Total estimated cost is $7,680,000. A contingency fee of $48,750 brings this amendment to $536,250 and the total contract to $1,090,400. (4981/Action Item 2) Approved 3-0
