Action Taken at June 2, 2015 Meeting

Shall the commission:

78. Authorize the executive director to terminate leases with Inner Landscape Acupuncture and A Better Way Massage LLC, d/b/a Bellwether Medical Acupuncture and modify a lease with Bellingham Medical Acupuncture? At the 11/5/2013 meeting, vote #157, the commission approved a lease with three acupuncture businesses for suite 219 at the Bayview Center Building. Bellingham Medical Acupuncture, Inner Landscape Acupuncture and A Better Way Massage d/b/a/ Bellwether Medical Acupuncture leased 1,300 square feet. The practices of Inner Landscape Acupuncture and A Better Way Massage LLC, d/b/a Bellwether Medical Acupuncture are in dispute so their leases will be terminated. A new lease will be signed with Bellingham Medical Acupuncture; it will expire on 11/30/2015. (5299/Action Item 1A and 1B) Approved 3-0

Action Taken at June 16, 2015 Meeting

Shall the commission:

79. Authorize the executive director to sign an agreement with the federal government for training exercises? The U.S. Department of Homeland Security, U.S. Immigration and Customs Enforcement and Homeland Security Investigations will use port property to conduct training exercises for law enforcement personnel in connection with border security. The federal government will accept legal responsibility for any property damage or personal injury. (5310/Consent Agenda B) Approved 3-0

80. Authorize the executive director to award the low bid of $998,518 to Rhine Demolition of Tacoma for the Waterfront District building dismantling and recycling project? A study by port staff has shown that it is unlikely the Digester Building, the Bark and Chipper Plant and Silos will be redeveloped. The estimated completion date of the project is January 2016. The work was advertised and seven bids were received. A contingency fee of $100,000 brings the total authorized contract to $1,098,518 (5306/Action Item 1) Approved 3-0

81. Authorize the executive director to sign a $66,000 contract with K Engineers of Lynden to perform electrical engineering, design, electrical usage monitoring, and bid support services for the Squalicum Marina and Blaine Harbor Marina power upgrade project? K Engineers will developing design and bid level drawings for selected power upgrades at Squalicum Marina and Blaine Harbor Marina as well as performing electrical usage monitoring at Blaine Harbor. Optimization of existing electrical infrastructure at Blaine Harbor is possible; optimization must be verified through electrical usage monitoring. A contingency fee of $6,600 brings the total authorized contract to $72,600. (5314/Action Item 2) Approved 3-0

82. Approve a memorandum of understanding with All American Marine of Bellingham for site preparation, construct a new building and negotiate a long-term lease at the Fairhaven site? All American Marine has been a port tenant at the foot of Harris Avenue since 2002. The company has outgrown Warehouse #9 and needs a larger manufacturing building. This agreement allows the project to move forward with specific benchmarks. The features include the following: the port pays for demolition of Warehouse #9 and site preparation ($1.5 million); the port constructs a new 39,000 sq. ft. building; the port uses the Economic Development Investment program grant/loan toward building cost (agreement is contingent upon this funding); the port and All American Marine will enter into a 25-year lease and a 20-year renewal option; All American Marine will reimburse the port for the building ($8 million less $1 million EDI grant) and interest (1.9 million) through lease payments; terms for termination by All American Marine or by the port -are as per contract. The port will receive a 3 percent return on its investment over the 25 year lease term. If the project is terminated during the design phase, All American Marine will pay the port one-half of project costs. (5311/Action Item 3) Approved 3-0

83. Authorize the executive director to apply for grant and loan funds from the Whatcom County Economic Development Investment Board program and the Washington State Community Economic Revitalization Board? The Economic Development Investment Board is funded by a sales tax rebate; it was created by the Whatcom County Council to make recommendations to the County Council on local economic development projects. If granted by the County Council, the $1 million grant and $2 million loan (1 percent interest) will be used to construct a new building at the All American Marine site in Fairhaven. (5311/Action Item 3) Approved 3-0

84. Authorize the executive director to spend $250,000 from the general fund for preliminary engineering, architectural, and consulting costs for the new building at the All American Marine site in Fairhaven? In the next vote, port staff is authorized to negotiate the work with Carletti Architects. (5311/Action Item 3) Approved 3-0

85. Authorize staff to negotiate a contract (amendment #2) with Carletti Architects of Mount Vernon to finalize the design and schedule shipyard remediation? In February 2014, the port entered into a contract with Carletti Architects for an initial feasibility assessment of Warehouse 9. The amount was not over $25,000 so it didn’t need commission approval. At the 10/7/2014 meeting, vote #127, the commission approved amendment #1 to the contract for a total of $35,000. (5311/Action Item 3) Approved 3-0
